TheCoolist respects your privacy rights and recognizes the importance of protecting your personal information and is committed to protecting the privacy of its users and providing them with a better social experience, subject to the Terms and Conditions. The purpose of this policy is to provide you with all the important personal information and explanations about how and why some of your data may be collected and processed by TheCoolist when you use one of our Apps or browse on our website or use any of our Services. This Privacy Policy governs and details the main principles that TheCoolist applies to the data we collect and process, to:

operate, develop and publish apps (“TheCoolist App”),
serve advertising that are tailored to the interests of users (“TheCoolist Ads”) and
run our website (“thecoolist.io”).

Contact Information

We collect contact information through our Service; contact information typically includes your name, email address, and any other information you provide in messages to us. We use such contact information for purposes such as providing you with information about the Service, responding to your inquiries, sending you email alerts (including marketing emails), verifying your identity or providing you the Service.

Account Access Information

In connection with the creation of an account on our Platforms, we collect account credentials such as your email, username, and password. We use this account information to create your account, including to verify your identity. We also use this information to manage your account, including your transactions. If you choose to log into your account on the Platform, we capture and store the User ID and email address connected to the respective account, so we can verify your identity when you log in.

Data on TheCoolist Platforms

TheCoolist collects data to provide you with the Services, as necessary, to run analytics and understand how users interact with our Services in order to continuously improve our Services. For this purpose, TheCoolist only processes or shares personal data collected through TheCoolist apps for analytics purposes once you express your consent through the pop-up notice included in our Platforms. Further information may be collected to serve advertising tailored to the preference and interests of our users once you express your consent through the pop-up notice included in one of our Platforms.

For all data processing activities that rely on users’ consent, you can withdraw your consent at any time from the “settings” page in our various applications. Please only note that in the case where you withdraw your consent or where you refuse to consent in the first place, you will still be served with advertising but that may be less relevant to you as it will not be tailored to your interests.

The legal basis for collecting and using Personal Information and data depends on what the personal information and data is and the context in which we collect the data.

In accordance with Article 6 of the General Data Protection Regulation “GDPR”, we will process your personal information for the purposes of TheCoolist’s legitimate interests pursued for ensuring secure optimization and improvement of Our Services, Platform and performance and for efficiently fulfilling our contractual obligations. In some cases, the processing is necessary for the compliance and fulfillment of a legal obligation, or to protect your vital interests or those of another natural person/user.

Our international affiliates and third-party websites or apps that our Services link to, or with whom we may have a presence, or with whom we may license use of our trademarks and copyrights, may collect and use personal information for their own purposes. Personal Information

“Personal Information” in this Privacy Policy is individual information about personal or objective circumstances of a specific or identifiable person, e.g. Your name, e-mail address, profile picture, bio, age, images, contacts, location tracking, location or IP addresses and device-related identifiers.

For the purposes of providing you with the Services listed above and on our Platforms, and to the extent necessary to fulfil one or more of its functions and activities, by reasonable means, you provide us with your Personal Information and details with your consent to use, share and make available, where applicable, to other users and/or any Third-Party or the public as deemed necessary.

We may collect Personal Information (information that can be used to identify you as an individual) such as, name, profile picture, bio, camera, email, telephone number, home address, demographic information (zip code, age), contact details (phone book). In addition to Data pertaining to your activities on our applications, website and Services and notably the way in which you interact with our applications, website and Services (for how long you use our application everyday) and with the advertising served in our applications (how many ads you see per day).

In furtherance, many of our Serviced require us to collect images and other information from your device’s camera and photos.

Usage Information

Whenever you use or visit our Platform and Services, TheCoolist, uses a variety of technologies to collect information about you (“Usage Information”). Usage Information include without limitations, the name of your internet service provider, the browser and the type of device, operating system, application, the time, the page served and the preceding page views and your use of features on the application version you are using, and any website that may refer you to us and the pages you visit to help manage and enhance the application. In addition to technical information about the device you use and your connection (user agent, type of connection, timestamp).

Device Identifier

Whenever you use or visit our application and services, TheCoolist, uses a variety of technologies to collect information about you your IP address or other unique identifiers for any device you use to access and use our application such as (computer, mobile phone, tablet or any other device). We, our affiliates, service providers, business partners or any third party may use a device identifier among other things, to administer the application; help diagnose problems, analyze trends, track users’ web page movement over time and access different websites, platforms or other mobile, online or offline services. We collect and identify your device primarily using your mobile device advertising identifier, e.g., Apple’s iOS Identifier for Advertising (IDFA) or Google’s Android Advertising ID, as well as other identifiers, which are technical identifiers developed by mobile operating systems for advertising purposes which remain under your control and can be reset or erased at any time in through your device settings.

Information from Others

We collect information about you when we receive it from other users, third parties, and affiliates. We collect information in accordance with the privacy policies and authorization procedures determined by those services. The information we receive depends on which TheCoolist app you are using, others or third-parties application, and your privacy settings.

Other Information You Provide

When you provide us with additional information other than the information under this Privacy Policy, We collect the information, for example when you communicate with others or post, use chat services, upload or store content, contact our Support Team, you give us your consent to process the provided information for the intended purpose.

Information we create or generate

We derive other information from the other data we collect about you, and we may combine this with other personal information to generate information about your likely preferences or other characteristics. For example, we infer your general location from your IP address.

Information obtained from third-party sources

In limited circumstances, we also obtain information from third parties. We protect information obtained from third parties according to the practices described in this statement, plus any additional restrictions imposed by the source of the information. These third-party sources include, for example:

Non-TheCoolist account operators;
Mobile Platforms: when you purchase our apps, we receive information from the app stores and other mobile platform providers about you that is limited to username or screen name and/or device ID and the fact a purchase was made, but no other sensitive or financial information, unless you authorize the mobile platform providers to provide us additional information;
Service Providers: third parties may collect any of the categories of personal information described above to provide services on our behalf, including to help us determine your device's general location based on its IP address to customize certain products to your location, provide you a more convenient experience, and provide additional security measures to protect our Services; and
Social Networks: where the information, including your name, screen name, and content you post, is publicly available to us, we may use such data for purposes such as measuring public reaction to the Services and to TheCoolist.

Geolocation Information

We may, with your consent, automatically collect geolocation information from your device via your browser’s location Service. This consent may be provided by you on the device level (e.g., you have consented to location Service generally through your browser’s settings) or by accepting our request for geolocation access on the Service. Please consult your browser’s documentation regarding how to turn off location Service. If you disable location Service, you may not be able to use the full array of features and functionalities available through our Service. We may also derive your approximate location from your IP address.

Use of Personal Information

We use information we have collected and stored for a variety of reasons; to provide you with our Services, to fulfill your requests in performing our contract with you, or based on consent where we have requested it or where required by law, and for our legitimate business objectives, including for a better social experience and/or information you request, such as new apps information alerts, promotions, participate in promotional activities, or otherwise, including without limitation:

Business Operations: to provide you with and operate, maintain, optimize, and improve our products, services, operations, and the security of our Services, including to perform operational tasks such as billing, accounting, communicating, and fulfilling your transactions for products and services;

Improvements: to Services, Platform, applications and your experience;

Service Delivery: to personalize content and experiences on our Services, including providing you recommendations based on your preferences;

Responses: to your questions, inquiries and requests, such as, app information, alerts and provide customer support services and technical support;

Communications: with you about your account and activities on the applications and in our sole discretion change to any TheCoolist policy or notice and to send and display administrative communications about TheCoolist and our partners and our respective products and services;

Tailored Services: tailor, manage and deliver content, advertisements;

Improvement, Development, and Research: to develop information to understand you based on demographics, your activity on our Services, responses to surveys, or activity on third-party websites and applications, including for purposes of troubleshooting and improving our Services; to conduct market research and perform statistical, demographic, and marketing analyses of users of our Services and their purchasing patterns;

In addition, to comply with the license and legal obligations, where applicable, for our records to enable us to operate and provide our Services, including providing users support, and improving, fixing, and customizing our Services, website and applications by developing and testing new services and features, to verify your identity, and prevent fraud or illegal activities, to provide you with access to the website, applications and some areas and features such as your interactions with other users, to notify you of application updates, new content and/or levels, to advice you of important safety-related information, and to enable you to participate in activities or programs and communicate with other users.

For the purposes listed above, we may also link or combine information about you with other personal information we receive from third parties. We also use personal information in settings and for the purposes described below.

Data to be Shared

TheCoolist does not share your personal data with third parties without your prior consent, other than as further stated hereunder. When you consent to the collection of data for advertising and analytics purpose, we may share the data listed above with the following categories of recipients:

With Your Consent. We will share information with companies, organizations, or individuals outside of Consent only when we have your consent to do so, and when you agree to our sharing your information with other third parties for their own purposes, subject to their separate privacy policies.
With Service Providers. We provide Personal Information to trusted partners with third-party vendors, consultants, and other service providers who work for us and need to access your personal information to do that work, including for business purposes that require access to our systems that hold personal information (such as supplying cloud data storage, maintaining the security of our systems, and providing customer support). based on our instructions and in compliance with appropriate confidentiality measures.
For Legal and Other Purposes. We may access, preserve, and disclose information to investigate, prevent, or take action in connection with: (i) legal process and legal requests; (ii) enforcement of our Terms of Service; (iii) claims that any content violates the rights of third parties; (iv) protecting the rights, property or personal safety of TheCoolist, its users, or the public; (v) establishing or exercising our legal rights or defending against legal claims; or (vi) as otherwise required by law (vii) if you’ve selected options available through our Services to publicly display your name and/or screen name and your other information.
With Ad Partners: We may allow others to provide analytics services and serve advertisements on our behalf across the internet and in applications. These entities may use cookies, device identifiers, and other technologies to collect information about your use of the Services, websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, or in apps, links clicked and conversion information. Which allows us to monetize the ad inventory of our apps and provide users with free products and services.

Analytic companies: that provide us with tools and technologies that allow us to better understand how users interact with our Services and will help us improve it. Those partners also usually collect data via their own software development kits.
Authorities: only to the extent we are obliged to by applicable laws and regulations.

Safeguarding your Personal Information

TheCoolist takes very seriously the security and privacy of the personal information that it collects pursuant to this Privacy Policy. Accordingly, we implement reasonable technical, organizational, administrative, and physical security measures designed to protect your personal information from unauthorized access, disclosure, alteration and destruction, and improper use, taking into account the risks involved in processing and the nature of such data, and to comply with applicable laws and regulations. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share your information (as permitted herein), nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

Third-Party Advertisers/Remarketers

We may share or receive information about you with/from third parties, including, but not limited to, advertising and remarketing providers, or similar partners, for purposes of personalizing or otherwise understanding how you engage with ads or other content. These third parties may use cookies, pixel tags, or other technologies to collect information in furtherance of such purposes, including to tailor, target (i.e., behavioral, contextual, retargeting, and remarketing), analyze, report on, and/or manage advertising campaigns or other initiatives. For example, when a browser visits a site, pixel tags enable us and these third-parties to recognize certain cookies stored within the browser to learn which ads or other content bring a user to a given site. Information that we may receive from these third-parties, including through their service providers, may include advertising identifiers, IP addresses, reports, and campaign data.

By accessing and using the Service, you consent to the processing of data about you by these advertisers/remarketing providers in the manner and for the purposes set out in this Privacy Policy.

For the purposes of providing you with the Services listed above on our applications, you provide us with your Personal Information and details with your consent to use, share and make available, where applicable, to other users and/or any third-party or the public.

Data collected for the purposes of Ad serving are only shared to the extent such data is necessary for the purpose they are following, which are advertisers that advertise inside our applications and Platforms to serve personalized or non-personalized advertising. When clicking on a third-party advertisement, you will no longer be on a Service or Platform provided by TheCoolist.

External Processing

We transfer information to our corporate affiliates, service providers, and other partners who process it for us, based on our instructions, and in compliance with this policy and any other appropriate confidentiality and security measures. These partners provide us with services globally, including for customer support, information technology, payments, sales, marketing, data analysis, research, and surveys.

If you participate in the Services of our websites, we will use personal information about you to track your location, results, level, ranking, rating, and status. Except for those jurisdictions where privacy law specifies a different age, (a) if you are 16 or older, we will post your full name or first name and last initial (as you direct us), as well as your state and country/region with your ranking and Virtual Items (as defined under the Terms) you have been awarded per the Services.

TheCoolist will keep your personal information within the App for as long as you keep the App on your device. If you create an account, the App sends your personal information to our servers. We keep your data for as long as you maintain an account and for 90 days after you disable the account, in case you choose to reactivate the account or in case the request to disable the account was in error. Certain apps may give you the option to receive push notifications. You can turn push notifications on or off through settings within the app or your device.

Analytics and Third-Party Cookies

We work with partners who provide us with analytics and advertising services. This includes helping us understand how users interact with the Services, serving advertisements on our behalf across the internet, and measuring the performance of those advertisements. These companies may use cookies and similar technologies to collect information about your interactions with the Services and other websites and applications.

TheCoolist uses technologies such as Device Identifiers and Cookies (data files placed on a device when its used to visit the application) to collect information and help analyze page view and flow, in addition, to associate users with social networking sites. Please be aware that some features and functionalities may not work properly without using Cookies because we may not be able to recognize and associate you with your TheCoolist account. As such, if you block or delete cookies, not all tracking that we have described in our Privacy Policy will stop. Also, please note that Third-Parties may opt to use cookies or similar files on your device to personalize your experience on their websites or applications. You may opt to decline cookies at any time.

Social Networks and other Communication Tools

Our website may, as we deem, offer communication tools allowing users to share content on social networks. In the event such communication tools have been offered and sharing content is allowed, when you interact with such social media widgets or “share buttons”, these social network companies may collect information about you and/or your device and connection. Your interactions with these services are governed by the respective privacy policies of the companies providing these services.

Children’s Privacy

We appreciate the importance of taking additional measures to protect children’s privacy.

Our Services are not intended for use by children. We do not knowingly or willingly collect, use, or share Personal Information from children under the age of 13 or 16 depending on the jurisdiction and the applicable law. If you believe that your child may have provided us with Personal Information, please contact us at support@thecoolist.io in order to suspend and/or terminate your child’s account.

If we learn that we have collected the personal information of a child under the relevant minimum age, we will take steps to delete the information as soon as possible. Parents who believe that their child has submitted personal information to us and would like to have it deleted may contact us at support@thecoolist.io.

Our guests can use some of our Services, view content, and enjoy many features without registering for an account or our collection of any personal information subject to COPPA.

If a user has indicated that they are a child when trying to create a TheCoolist Account, we will not allow the child to provide any personal information, and will refrain from allowing the child access and/or use of our Services and the Platform.

International Operations and Data Transfers

TheCoolist is based in Jordan, and we process and store information on a secure server. As such, we and our service providers may transfer your information to, or store or access it in, other jurisdictions. We will take steps to ensure that your personal data receives an adequate level of protection in the jurisdictions in which we process it.

Please note that the countries where we operate may have privacy and data protection laws that differ from, and are potentially less protective than, the laws of your country. You agree to this risk when you create a TheCoolist Account and click “I agree” to data transfers, irrespective of which country you live in.

Retention

We will only keep your Personal Information only for as long as appropriate to fulfill the purposes for which it was collected, maintain your accounts, to provide Services, to fulfill your requests, for legal compliance and enforcement purposes, and for resolving disputes, to comply with Our business requirements, applicable laws and meet our legal obligations.

Actual retention periods depend on a variety of factors, such as the type of product, the type and sensitivity of the data, business needs, customer expectations and needs, the types of available user controls, and the form in which the data is stored.

Rights

At the outset, you can access and update the contact information you gave us during registration by visiting the “Edit Profile” section on Platform.

You can contact us at support@thecoolist.io with requests to delete, access, and update your personal information. If you choose to delete your account, please note that while most of your information will be deleted within 30 days, it may take up to 90 days to delete all of your information.

You can opt out of our promotional emails by clicking “unsubscribe” in those emails.

You can choose to block and/or remove all cookies and local storage. You can also opt out of many of the third-party analytics and advertising cookies.

You can opt out of our advertising on mobile apps by using the advertising settings in your mobile device.

You can prevent tracking of emails we send you by changing your settings to turn off HTML or disable downloading of images. In addition, you may also unsubscribe from our marketing emails by following the instructions in those emails.

Consent withdrawal and opt-out

You can change your consent status at any time from the Privacy Settings available in TheCoolist Platforms.

Please note that if TheCoolist does not sell the Personal Information of its users, we may share it with third parties such as analytics and advertising companies in order to improve and personalize your experience and adapt the content and ads of our services.

Adjusting your consent settings within TheCoolist apps, will allow you to block the collection of data for these purposes and will de facto prevent the sharing of information with our analytics and/or advertising partners.

Access right

In accordance with Article 15 of GDPR, upon Your request, TheCoolist will provide You with information concerning You, and whether we hold any of your Personal Information. You may access Your Personal Information or request deletion of your Personal Information by contacting TheCoolist support as indicated in the “Contact” section below. We will respond to your request within a reasonable timeframe. If you have linked a social account, then you can unlink the app with those social providers to disassociate yourself with any stored data. If you do this, your username may no longer be retrievable.

In addition to the above, you shall have the following rights:

A right to be informed of the ways in which we use your information.
A right to request from TheCoolist access to personal data, including (i) the categories and specific pieces of information we have collected about you, (ii) the categories of sources collected, (iii) the purpose for collecting or using the information, and (iv) the third parties with whom we share your personal information; and rectification or deletion/erasure of personal information under certain circumstances and subject to a number of exceptions, and certain rights to data portability.
A right to object to the processing of your personal data or obtain a restriction of such processing under certain circumstances.
A right to have your personal data transferred to another organization should it be technically feasible for TheCoolist to do so.

If the processing of personal data is based on your consent, a right to withdraw consent at any time (without affecting the lawfulness of processing before its withdrawal)

There may be exceptions to these rights in certain circumstances, and where you cannot exercise a right due to an exception, we will provide that explanation.

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject cookies; however, the Services may not function properly if you do so as some functions of the website may not be displayed correctly.

Cookies contain information about the current or last visit to Our Platforms, for example, the type of device You are using, your operating system version, your mobile device’s identifiers, Your browser types and language, exit pages and URLs, number of clicks on a page or feature, domain names, pages viewed and order and amount of time spent on particular pages.

Notifications

You have the ability to turn application notifications on and off by adjusting the settings of your mobile device. If you wish to allow or discontinue receiving Push Notifications or Local Notification, please consult the settings on your mobile device.

Rectification and Erasure

You may request TheCoolist the rectification of inaccurate personal data concerning you, as well as the completion of incomplete personal data in accordance with Article 16 of the GDPR. You may also contact and request TheCoolist to erase without undue delay your personal data when it is no longer necessary for TheCoolist to retain such data in relation to the purposes for which they were collected or processed (Article 17 GDPR).

California Privacy Rights

This section provides you with additional disclosures required under California law. Therefore, if you are a California resident, please review the following additional privacy disclosures under the California Consumer Privacy Act ("CCPA").

The CCPA provides you with certain rights. You have a right not to be discriminated against for exercising any of these rights. You may exercise these rights using your account settings and tools as available on the Platforms, or alternatively by contacting us as stated hereunder.

California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding disclosure of personal information to third parties for their own direct marketing purposes. If you are a California resident under the age of 18, and a registered user of any Service where this Privacy Policy is posted, you may request and obtain removal of content or information you have publicly posted. To make such a request, please send an email with a detailed description of the specific content or information to support@thecoolist.io. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted, and that there may be circumstances in which the law does not require or allow removal even if requested.

General

We may update, change or modify this Privacy Policy and you accept to be solely responsible for reviewing the Policy from time to time as any update, change or modification by TheCoolist shall effective immediately upon posting at any time and at its discretion.

This Privacy Policy is an integral part of the Terms and shall be read with it all the time, the other provisions available on the Terms and Conditions shall apply on this Privacy Policy.
